The following terms and conditions of use (the "terms and conditions") govern your ("you") use of the Alivestock service (the "Service"), as provided by Alivestock LTD ( the company or "we").

Registration Eligibility :
Staff-: In order to use the Service you must be over 18 years of age and an industry professional.
Employer:- In order to use the Service you must be a genuine employer look to find professionals for paid positions.

Services Available on the Site:
Alivestock Ltd may make certain services available to individuals who register on the Site ("registered users") and general visitors to the site ("visitors") (registered users and visitors are collectively referred to as "users"). For example, Users ‘may’ be able to register to receive profile alerts, search our user database, participate in contacted or moderated discussions with other users, post comments on a bulletin board, post and respond to profiles, or upload their profile (collectively, "services", and with the site, the "Site"). Alivestock Ltd may make certain forums available on the site that allow registered users the opportunity to participate in discussions and to post information on bulletin boards (collectively, "Forums"). Registered Users who participate in these forums are solely responsible for the information and other content they post on and through these forums and should be aware that when they voluntarily disclose personal information (e.g. name, email address, telephone number) on or through these forums, such information is generally accessible to and may be collected and used by other Registered Users, as well as visitors, and may also appear in search engines and may result in unsolicited online and offline messages. Registered Users are strongly encouraged to exercise discretion when providing personal information about themselves in and through forums. Alivestock ltd reserve the right to Alter and change its service as and when the director pleases.
You acknowledge and agree that in connection with your use of the site you must: (a) provide for your own access to the World Wide Web and pay any service fees associated with such access, and (b) provide all equipment necessary for you to make such access and connection to the World Wide Web, including a computer, software, a modem and a means of connecting to or accessing the Internet. Alivestock Ltd shall not be responsible for any malfunctions, errors, crashes or other adverse events that may occur from your use of the Site.

YOUR REGISTRATION OBLIGATIONS:
In consideration of your use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service’s registration (such information being the “Registration Data”) and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, the Company has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof). In the course of your use of the Site, you may be asked to provide certain information about yourself to us ("User Information"). You acknowledge and agree that you are solely responsible for the content of the User Information and that all User Information is accurate, including the content of your Profile and any messages you send through Alivestock.com.

Payment, subscription and cancellation:
By clicking the ‘Continue’ button you agree to the T&C. By completing and submitting the following electronic order form you are making an offer to purchase a service which, if accepted by us, will result in a binding contract. No contract for the provision of the Service shall exist between us until acceptance by the Alivestock Ltd will have periodic subscription fees that are defined by the terms of the site at the time of the initial enrolment for subscription. The subscriber is responsible for such fees according to the terms of the site. Subscriptions can be cancelled by contacting Customer Service at admin@alivestock.com. Subscribers will receive by email a copy of the account of charges made for the use of the site. Pursuant to the Consumer Protection (Distance Selling) Regulations 2000 (the “Regulations”) you are entitled to a 7 day cooling off period (the “Cancellation Period”) which, subject to the receipt by you of the confirmation of this contract in writing by email, begins the day after the day on which the contract for services is concluded. You will forgo your right of cancellation for the provision of the Services when performance of the contract has begun, when your consent has been given before the end of the cancellation period. Your acceptance of the T&C represents your consent to the performance of the contract. Refunds will be given at the discretion of the Company Management.

ALIVESTOCK.COM'S DATA PROTECTION & PRIVACY POLICY:
Please note that your personal data will be stored and processed on our computers in the UK and that the Company will hold and transmit your information in a safe, confidential and secure environment.Alivestock.com will not sell or rent your personal data to third parties except as described in the Data Protection and Privacy Policy. If you object to your personal data being transferred or used in this way please do not register.You are responsible for maintaining the confidentiality of your username and password. You shall be responsible for all uses of your account, whether or not authorised by you. You agree to immediately notify the Company of any unauthorised use of your username or password.

User Conduct:
You may not under any circumstances sell the Data nor may you make or sell any copy or reproduction of it or any substantial part of it. You may not make any modifications to the software and you may not use any means to decompile the software except as specifically provided by law and with the written permission of the Company and you may not attempt to decipher, disassemble or reverse engineer any of the software comprising or in any way making up a part of the Web Site. Alivestock Ltd provide a service aimed at genuine industry professionals. You warrant and agree that you shall not:

  1. Upload, post or transmit to or distribute or otherwise publish through the Site any material that violates any provision of these Terms and Conditions or the law of the State or Country in which you are based;
  2. Restrict or inhibit any other User from using and enjoying the Site;
  3. Contact users for any non-professional reason;
  4. Send identical bulk emails;
  5. Constitute or encourage conduct that would constitute a criminal offence or give rise to civil liability;
  6. Impersonate, or misrepresent your affiliation with any other person or entity;
  7. Upload, post, publish, transmit, reproduce, distribute or in any way exploit any information or other material obtained through the Site for commercial purposes (other than as expressly permitted by the provider of such information or other material);
  8. Engage in spamming or flooding;
  9. Attempt to gain unauthorized access to other computer systems through the Site. Except as otherwise expressly permitted herein, you may not upload, post, publish, reproduce, transmit or distribute in any way any component of the Site itself or derivative works. We have no obligation to monitor any content on or through the Site and we assume no obligation. You acknowledge and agree, however, that we do retain the right to monitor the Site and to disclose any information as necessary or appropriate to satisfy any law, regulation or other governmental request, to operate the Site properly, or to protect ourselves or our Users. Under no circumstances will the Company be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or for any loss or damage of any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise transmitted via the Service to upload, post, email or otherwise transmit any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable. Any information or material that you submit or send to Alivestock Ltd or otherwise make available on or through the Site ("Your Material") will be deemed not to be confidential or secret. By submitting or otherwise making Your Material available on the Site, you;
  10. Agree and acknowledge that Your Material will not be treated as confidential or proprietary;
  11. Agree and acknowledge that Your Material is owned by Alivestock Ltd;
  12. Represent and warrant that Your Material;
  13. Is original to you and that no other party has any rights to the material;
  14. Does not contain any content that is unlawful, threatening, harassing, profane, tortious, defamatory, vulgar, obscene, libelous, deceptive, fraudulent, contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), invasive of another's privacy, or hateful;
  15. Does not contain a virus or other harmful component; and
  16. Does not contain, unless the specific Service allows, any advertising of any kind, or false or misleading indications of origin or statements of fact.
  17. Alivestock Ltd the royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive and fully sub-licensable right and license to use, reproduce, modify, edit, adapt, publish, translate, create derivative works from, distribute, perform and display Your Material (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, including Alivestock sites and network, and that Your Material may appear in search engines. You also warrant that any "moral rights" in Your Material have been waived;
  18. Agree and acknowledge that Your Material may appear in google and other search engines;
  19. Alivestock Ltd reserve the right to view the content of all mail passing through the site;
  20. Alivestock Ltd reserve the right not to post and to remove any User Information, subscriptions, profiles, messages, and content therein without notice;
  21. Alivestock Ltd reserves the right without warning to deny and/or cancel membership to any person who we deem from their profile or use of the site to be unsuitable for the service.

You acknowledge that the Company does not pre-screen Content, but that the Company and its agents shall have the right (but not the obligation) in their sole discretion to refuse or remove any content that is available via the Service. Without limiting or foregoing, the Company and its agents shall have the right to remove any Content that violates the T&C or is otherwise objectionable. You will agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by the Company or submitted to, including without limitation information in uploaded data, and in all other parts of the Service. You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.

INDEMNITY:
You agree to indemnify and hold the Company and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable legal fees made by any third party due to or arising out of Content you submit, post to or transmit through the Service, your use of the Service, your connection to the Service, your violation of the T&C, or your violation of any rights of a third party.

GENERAL PRACTICES REGARDING USE, STORAGE AND MODIFICATIONS:
You acknowledge that the Company may establish general practices and limits concerning use of the Service, including without limitation the maximum number of days that email messages, message board postings or other uploaded Content will be retained by the Service, the maximum disk space that will be allotted on Alivestock.com servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Service in a given period of time. You agree that the Company has no responsibility or liability for the deletion or failure to store any messages and other communications or other Content maintained or transmitted by the Service. You acknowledge that the Company reserves the right to close down the accounts that are inactive for an extended period of time. You further acknowledge that the Company reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice. The Company reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that the Company shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
You agree that the Company, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any Content within the Service, for any reason including, without limitation, lack of use or if it believes that you have violated or acted inconsistently with the T&C. The Company may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this T&C may be effected without prior notice, and acknowledge and agree that the Company may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that the Company shall not be liable to you or any third-party for any termination of your access to the Service.

No Endorsement:
Alivestock Ltd is not responsible for and does not represent or warrant the truthfulness, accuracy or reliability of any material posted by others on or through the site, nor does Alivestock Ltd endorse any opinions expressed by Users or others. Alivestock Ltd is not responsible for the online or offline content of Users. Users acknowledge that any reliance on material posted by others will be at their own risk. Any content placed on any discussion area by Users are the views of the User posting the statement, and do not represent the views of Alivestock Ltd.

Proprietary Rights:
Any commercial use of the Site is strictly prohibited, except as allowed herein or otherwise approved by us. You may not download or save a copy of any of the content or screens except as otherwise provided in these Terms and Conditions, for any purpose. You may, however, print one (1) copy of the information on the Site solely for your personal use or records. If you make other use of the Site, except as otherwise provided above, you may violate copyright and other laws of the United Kingdom, other countries, as well as applicable state laws and may be subject to liability for such unauthorized use. We do not grant any license or other authorization to any user of our trademarks, service marks, other copyrightable material or any other intellectual property, by including them on the Site. You also agree and acknowledge that any ideas, concepts, methods, systems, designs, plans, techniques or other similar materials that you submit or otherwise communicate to the Site, may be used by us in any manner.

THE COMPANY'S LIABILITY:
Alivestock.com is only a venue. This Web Site acts as a venue for candidates to post their contact details and fortnightly job availability and for employers to be able to search candidates availability. The Company does not screen or censor the listings offered nor is the Company involved in the actual transaction between employers and candidates. As a result, the Company has no control over the quality, safety or legality of the jobs or information posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings. In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretences. You assume all risks associated with dealing with other users with whom you come in contact through the Web Site.
Because user authentication on the Internet is difficult, the Company cannot and does not confirm that each user is who they claim to be. Because we do not and cannot be involved in user-to-user dealings or control the behavior of participants on Alivestock.com, in the event that you have a dispute with one or more users, you release the Company (and our agents and employees) from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. We are under no legal obligation to, and generally do not, control the information provided by other users which is made available through the Web Site. By its very nature, other people's information may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. We expect that you will use caution and common sense when using this Web Site. The Material may contain inaccuracies or typographical errors. The Company makes no representations about the accuracy, reliability, completeness, or timeliness of the Web Site or the Material. The use of the Web Site and the Material is at your own risk. Changes are periodically made to the Web Site and may be made at any time. The Company is not to be considered to be an employer with respect to your use of the Web Site and the Company shall not be responsible for any employment decisions, for whatever reason made, by any entity posting jobs on the Web Site. The company does not warrant that the web site will be error-free or that the web site and its server are free of computer viruses or other harmful mechanisms. If your use of the web site or the material results in the need for servicing or replacing equipment or data, the company is not responsible for those costs.
The Web site and material are provided on an ‘as is’ basis without any warranties of any kind. The company, to the fullest extent permitted by law, Disclaims all warranties, whether express or implied, including the warranty of merchantability, fitness for a particular purpose and non- infringement. The Company makes no Warranties about accuracy, reliability, completeness, or timelessness of the material, services, software, text, graphics, and links. In no event shall the company, it’s suppliers, or any third parties be liable for any damages whatsoever ( including, without limitation, incidental and consequential damages, lost prophets, or damages resulting from lost data or business interruption) Resulting from the use or inability to use the web site and the material, whether based on warranty, Contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages.

Additional terms for employers:
You warrant that you are a bona fide employer and that you will register and log on as such. You shall use the Information contained on the Website for the sole purpose of considering employing or otherwise retaining the services of the individuals and organizations contained on the Website. By using the Alivestock Ltd system in any way, you are agreeing not to use the system to solicit, promote, or otherwise, any products or services. The system is for employment purposes only. By violating this agreement, you agree to pay Alivestock three hundred pounds and each recipient three hundred pounds per offending message or e-mail. You acknowledge that the Information is the property of Alivestock Ltd and that you shall not copy or otherwise disseminate it. The license granted herein is personal and may not be assigned. We do not provide any warranty or guarantee concerning the information relating to individuals contained on the Website (the 'Information') and therefore we cannot accept any liability associated with its use.

Additional terms for job seekers:
We cannot guarantee work, as the jobs rest with the employers and are affected by the state of the industry as a whole. We cannot guarantee that employers who view your profile will call you in for an interview or that you will be offered the position after interview. Those decisions rest with the employers. We are unable to verify or provide any assurance relating to the nature or duration of any work or appointment that you may be offered as a result of using the Service. It remains your sole responsibility to ensure that any work or appointment is acceptable to you.

SEVERABILITY & JURISDICTION:
In the event that any of the terms, conditions or provisions of the T&C shall be determined by a competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision shall to that extent be severed from the remaining terms, conditions and provisions which shall continue to be valid to the fullest extent permitted by law. The laws of England shall govern the T&C and your use of Alivestock.com and the parties hereby submit to the exclusive jurisdiction of the English courts.
